Organic Acres

The Future of Gardening

Can International members be a part of Organic Acres?

Unfortunately shipping produce outside the U.S. is not permissible but you certainly can participate in Organic Acres.

While you have the option of leasing a Full or Half Garden, anything you would grow in your garden would need to be sold to the community members through the Farmers Market here in the U.S.

This will be available during the summer months. You would also have the option to donate to our local food banks..

Please keep in mind you would be selling your produce along with many others in the farmers market, so it's hard to say just how much you could make should you decide on leasing a garden, but it's an option open to you.

You could join one of the 3 General Store memberships available, but at this time, it looks as if we may have a problem shipping these items internationally due to customs regulations.

At present your best options would be to join as a Free or Basic member.

Here is a link that explains the Free membership, as well as what you would be entitled to as a Basic member:

http://support.gpcoffice.com/desk/organicacres/index.php?action=kb&article=85

You can earn commissions on anyone you'd bring into your community by giving them your Organic Acres link up to 5 levels deep as a Basic member & up, 1 level as a Free member.

Here are your Garden/Membership options:

http://support.gpcoffice.com/desk/organicacres/index.php?action=kb&article=79

Here's how to tell others about Organic Acres..

http://support.gpcoffice.com/desk/organicacres/index.php?action=kb&article=77

Rick Price

Is this membership available if I live in Canada?

We are actively working to get Gardens up and going in Canada..I can't give you a timeline, but it's in the works.

Unfortunately produce can not be shipped across the border from the U.S.
Rick Price

Why am I not getting your emails?

Please be sure to whitelist admin@myorganicacres.com in your email provider and please check your spam folder.

More specific instructions can be found on your Organic Acres back office home page.
Rick Price

Do I pay shipping and how much will it cost?

Yes, the member will pay for shipping.

Shipping costs are based on weight and location, so we can not give you an exact price, but a close approximation.

You will have these methods of shipping:

Overnight
2nd day air
Regular ground - General Store products

We will be using FedEx and UPS.

As of this time, we are looking at a 25% discount with FedEx and perhaps a bit better with UPS through our system. Exact prices will be in place once we have the produce selections up for you to plant in your garden, which will be in mid February sometime.

You will be able to set up your own shipping schedule for your garden produce.

We now have a dedicated rail line shipment method available to our East Coast members..

Here is the link to give you information on the rail line service..

http://railexusa.com/

Train Departing and arrival times..

http://railexusa.com/4trains.php

The train will deliver your shipment to it's distribution point and from there it will be delivered to FedEx where they will deliver to your door step.

To give you an estimated cost for a 40lb - 60lb box, The railex cost would be $15 to the East Coast and the FedEx cost around $12- $25 for a total of $27 to $40 dollars. The FedEx portion cost would be a bit more the further away you live from the distribution site, which is in Albany, N.Y.

For Mid Atlantic States -- West and South of Minnesota and Arkansas..We will be shipping your produce by what is called Reefer Trucks -- (these are refrigerated units).

Your base cost will be $10 in the West - $12 for the Midwest to ship using these trucks, then a $12 - $25 FedEx charge, depending on actual weight to be delivered to your door.  These prices are based on a 40lb - 60lb box.

Delivery is usually the next day (up to 150 miles) depending on how far you are from the hub.

You can also choose to offset the cost of some of your shipping as well,  by selling some of your produce in the Farmer's Market if you'd like, or give to our local food banks.

For more information on how to order your garden crops.. Please login to your backoffice and at the top of the page there will be a link entitled:

Click here to Order produce for your garden today!

On that page is a list of what is available to plant in your garden.

Jerry suggested around 40 plants for a Full Garden, 20 for a Half Garden, again this is just a general estimation, as it will depend on what you want planted.

Perhaps this link will give you a ballpark idea of what can be planted in a plot comparable to the 240 sq. foot. Hers is a 260 sq. foot area..so, for a half garden, you would half that approximately.

Pioneers

Are you always a Pioneer if you pay your maintenance fees for that first full year, then decide to downgrade the next?

Yes, once you meet that first year commitment, you will always be a Pioneer as long as you remain at least a Basic Member.

Should you downgrade to a Free Member, you will lose your Pioneer Position..

Rick Price

How does the Pioneer Program work?

As we kick off what may prove to be the Farms of the Future, we are going to allow the pioneers that start with us to share in the future profits. We are providing 12% of all future profits in the company to those first signers.

Here is how it works:

1. The first 1,000 members that start a full garden will equally and annually split 4% of all company profits.

2.The first 2,000 members that start a half garden will equally and annually split 4% of all company profits.

3.  The first 1,000 members that start an herb garden will equally and annually split 2% of all company profits!

4. The first 2,000 1 year members will equally and annually split 2% of all company profits.

You must meet the 12 month requirement for all leases/memberships to become a Pioneer..if you decide to drop out before your 1 year commitment, you will lose your Pioneer position.

Company profits will be paid at years end.

==============================

As of July 1st..there are Pioneer Positions still available..for more information please refer to the link below:

How do the Pioneer Rebates work for our gardens?

For the Full-Garden:

Your full garden price is $299.95. We give you a rebate for $300. That rebate is worth $300 when one of three things happen

1. When you sub-lease your garden to someone.

You can keep the rebate for yourself for next year or use it for a bargaining chip to get a higher price when you give it to the sub leaser.

2. If you decide to let us sub lease your garden and we do you will receive a cash rebate of $300 once the sub lease is completed.

3. Or after you have finished your Garden year you decide to re-lease a garden next year you will receive $300 off the full garden price which all new garden owners will pay $599.95 making your price only $299.95.

We say you get the lease for free because assuming you use the rebate in one of the above ways you will get $300 in cash or discounts.

For the Half-Garden:

Your half garden price is $199.95. We give you a rebate for $200. That rebate is worth $200 when one of three things happen

1. When you sub-lease your garden to someone.

You can keep the rebate for yourself for next year or use it for a bargaining chip to get a higher price when you give it to the sub leaser.

2. If you decide to let us sub lease your garden and we do you will receive a cash rebate of $200 once the sub lease is completed.

3. Or after you have finished your Garden year you decide to re-lease a garden next year you will receive $200 off the full garden price which all new garden owners will pay $349.95 making your price only $149.95 or you can upgrade to a full garden using your $200 rebate and while new garden members will pay $599.95 for their new garden you will only pay $399.95.

We say you get the lease for free because assuming you use the rebate in one of the above ways you will get $200 in cash or discounts.

For the Herb-Garden:

Your herb garden price is $149.95. We give you a rebate for $150. That rebate is worth $150 when one of three things happen

1. When you sub-lease your garden to someone.

You can keep the rebate for yourself for next year or use it for a bargaining chip to get a higher price when you give it to the sub leaser.

2. If you decide to let us sub lease your garden and we do you will receive a cash rebate of $150 once the sub lease is completed.

3. Or after you have finished your Garden year you decide to re-lease a garden next year you will receive $150 off the full herb garden price.

We say you get the lease for free because assuming you use the rebate in one of the above ways you will get $150 in cash or discounts.

The lease is transferable with the express permission from Organic acres. If you choose to lease the Gardens to someone else you must first inform Organic Acres.

The person that sub leases them must be responsible for the monthly maintenance fee and have a payment method on file with us to cover the automatic monthly maintenance payments.

The Gardens

Where is the Farm located?

The farm is located 10 to 15 miles South of Portland, Oregon.

Here is the address:

17838 Monnier Rd.
Hubbard, Oregon 97032

We are actively in touch with other organic farms from other states and as we progress with this one, we hope to franchise U.S wide. Once this happens, you would have the choice to transfer your garden, should it be closer to you.

How often can I order from my garden?

As often as you would like once what you've had planted is approaching harvest time. You will be able to set up your own shipping schedule as well.

Updates will be available to you on how everything is progressing from your backoffice area, whenever anything is approaching a harvestable time for shipping, you will be notified well in advance.

Will you be using any genetically altered seeds, any irradiation methods or GMO food products?

NO, everything will be strictly organic and natural..
Rick Price

Are there Full Gardens left?

In the event that all of the Full Gardens have been filled, we are opening up 2 Half Gardens for those who are interested until that 2,000 quota has been filled.

Once those are filled, members will be placed on a waiting list, and should anyone decide that they can't continue, spots will open up for Full and Half Gardens.
Rick Price

How long does it take for your first crop to harvest?

Your harvest will depend on what you planted, if you want lettuce, it will be harvestable before say tomatoes. If you want watermelons, it would take the whole summer before harvest. Different vegetables ripen at different times.

Whenever something is ready in your garden, you will be kept appraised in your community garden back office when it can be picked, shipped and or sold.

Rick Price

When will planting start?

Typically the growing season will start towards the end of April, first part of May.

There will be some crops available year round, such as herbs that can be grown in the greenhouses with the addition of the herb garden lease choices.

Can we plant something else in our garden, once something has been harvested?

That is dependent on what you want planted and how far into the growing season it is, however, it's possible to re-plant another crop if there's enough time for it to reach maturity before the end of the growing season.
Rick Price

What sizes are the Garden Plots?

Full Garden:

20' by 12' ---- 240 sq. feet

Half Garden:

10' by 12' ---- 120 sq. feet

Herb Garden:

5' by 3' ----- 15 sq. feet
Rick Price

What kind of yield could I possibly expect from a Full Garden?

While it will depend on what you have planted in your garden in regards to yield..Perhaps this blog will give you a general idea of what you may expect to harvest from a similar size plot to the Full Garden option.

Garden Plot sizes can be found in the link below..

If you can attend any of our live meetings, we are given the most up to date information there..as well as details on how you can use a program to plan your garden.

Organic Acres Garden Lease Agreement

1. Leased Premises; Term of Lease; etc;

1.1 Leased Premises. Landlord leases to Gardener from Landlord, the Garden (full or half) located at: Oregon USA.

1.2 Original Term. This Lease shall commence immediately and, unless sooner terminated pursuant to law or pursuant to any of the terms hereof, shall expire one year from the first monthly maintenance fee payment.

1.3 Renewal Term. Gardener shall have the right, exercisable as hereinafter provided, to extend the term of this Lease for one successive period of one year upon the same covenants, terms and conditions as those provided in the Lease for the Lease Term. If Gardener desires to preserve the right to extend the Lease Term for a Renewal Term, Gardener shall give Landlord a notice no later than 30 days before the end of the Lease Term.

1.4 Use of Premises. Gardener shall use the Premises as a vegetable garden only, and for no other purpose. The Premises shall not be used to carry on any type of business or trade, unless Gardener has received the prior written consent of the Landlord. Gardener will comply with all laws, rules, ordinances, statutes and orders regarding the use of the Premises.

1.5 Inspection of Premises. Gardener or Gardener's agent has the right to inspect the Premises, the fixtures, the grounds, building and improvements and acknowledges that the Premises are in good and acceptable condition for gardening.

2. Monthly Maintenance Payments;

2.1 Monthly Maintenance fees. Gardener shall pay to Landlord during the Lease Term as Monthly Maintenance fees, for the Garden the amount as stated upon purchasing the garden site each month in advance on the prescribed day of each month.

2.2 Manner of Payment. The Monthly Maintenance, and all other sums payable by Gardener to Landlord under this Lease, shall be payable in lawful money of the United States of America and shall be paid to Landlord and Landlord's website address, or at any other address designated by Landlord.

2.3 Late Fees. If any amounts due under the Lease are more than 30 days late, Gardener agrees to pay a late fee of $10.

2.4 Insufficient Funds. Gardener agrees to pay the charge of $25 for each check provided by Gardener to Landlord that is returned to Landlord for lack of sufficient funds.

3. Lease Deposit;

3.1 Lease Deposit. On execution of this Lease, Gardener shall deposit with Landlord a lease deposit equal to the lease cost signified on the website at the time of upgrade as security for the performance of Gardener's obligations under this Lease. Landlord may (but shall have no obligation to) use the Deposit or any part thereof to cure any breach or default of Gardener under this Lease, or to compensate Landlord for any damage as it incurs as a result of Gardener's failure to perform any of Gardener's obligations hereunder. Landlord is not limited to the Deposit to recoup damage costs, and Gardener remains liable for any balance. Gardener shall not apply or deduct any portion of the Deposit from any month's Monthly Maintenance fees, including the last month of the Monthly Maintenance fees. Gardener shall not use or apply the Deposit in lieu of payment of Monthly Maintenance fees. If Gardener breaches any terms or conditions of this Lease, Gardener shall forfeit the Lease Deposit, as permitted by law.

4. Default;

1 Event of Default. If Gardener defaults in fulfilling any of the covenants of this Lease, Gardener shall be in default of this Lease. Then, in any one or more of such events, subject to any statute, ordinance or law to the contrary, and upon Landlord serving a written thirty (30) days e mail notice upon Gardener specifying the nature of said default and upon the expiration of said thirty (30) days, if Gardener does not cure a default of which he has been notified, or if the default cannot be completely cured or remedied in thirty (30) days, Landlord may at Landlord's option: (i) cure such default and add the cost of such cure to Gardener's financial obligations under the Lease; or (ii) declare Gardener in default and terminate the Lease.

4.2 Physical Remedies. If the notice provided for in Section 4.1 has been given, and the term shall expire as noted, or if Gardener shall make default in the payment of Monthly Maintenance fees then Landlord may without notice, as permitted by law, re-lease the Garden or otherwise, dispossess Gardener by summary proceedings or otherwise. Gardener hereby waives the service of notice of intention to re-lease or institute legal proceedings to that end.

4.3 Financial Remedies. In the event of any default, re-lease, expiration and/or dispossession by summary proceedings or otherwise, (i) the Monthly Maintenance fees, shall become due thereupon and be paid up to the time of such re-lease, dispossession or expiration, together with such expenses Landlord may incur for legal expenses, attorneys' fees, brokerage, and/or putting the Garden in good order; (ii) Landlord may re-let the Garden or any part or parts thereof; and/or (iii) Gardener shall also pay Landlord liquidated damages for his failure to observe and perform the covenants in this Lease. Landlord may, at his sole option, hold Gardener liable for any difference between the Monthly Maintenance fees, payable under this Lease during the balance of the Lease Term, and any Monthly Maintenance fees, paid by a successive Gardener if the garden is re-let. In the event that after default by Gardener Landlord is unable to re-let the Premises during any remaining term of this Lease , Landlord may at his option hold Gardener liable for the balance of the unpaid Monthly Maintenance fees, under the Lease for the remainder of the Lease Term.

5. Crop Disbursement;

5.1 Crop Disbursement. Landlord covenants and agrees with Gardener that upon Gardener paying Monthly Maintenance fees and observing and performing all of the terms, covenants and conditions on Gardener's part to be observed and performed under this Lease, Gardener may ship or pick up all crops grown in or pertaining to the garden, subject nonetheless to the terms and conditions of this Lease.

6. Assignment and Subletting;

6.1 Assignment. Gardener expressly covenants that it shall not assign or sublease any interest in this Lease without prior e-mail consent of the Landlord, which consent shall not be unreasonably withheld. Any assignment or sublease without Landlord's e-mail prior consent shall, at Landlord's option, terminate this Lease. No assignment, sub leasing, or collection shall be deemed a waiver of the provisions of this Lease, the acceptance of the assignee, under Gardener, as Gardener, or a release of Gardener from the further performance by Gardener of covenants on the part of Gardener in this Lease.

7. Abandonment;

7.1 Abandonment. If at any time during the term of this Lease Gardener abandons the Garden or maintenance fees or any part thereof, Landlord may at his option obtain possession of the Garden by any legal means without liability to Gardener and may, at Landlord's option, terminate the Lease, re lease the garden or take control of all crops in the garden. Abandonment is defined as failure to pay the monthly maintenance fees. If Gardener abandons the Premises while the Monthly Maintenance fees is outstanding for more than 30 days and there is no reasonable evidence that Gardener is willing to continue the maintenance fees, Landlord may at Landlord's option terminate this Lease and regain possession of the crops from said garden and dispose of them as they see fit in the manner prescribed by law and Landlord is hereby relieved of all liability for doing so.

8. No Other Representations, Construction; Governing Law; Consents;

8.1 No Other Representations. Gardener expressly acknowledges and agrees that Landlord has not made and is not making, and Gardener, in executing and delivering this Lease, is not relying upon, any warranties, representations, promises or statements, except to the extent that they are expressly set forth in this Lease. It is understood and agreed that all understandings and agreements heretofore had between the parties are merged into this Lease, which alone fully and completely expresses their agreements.

8.2 Construction and Serviceability. If any of the provisions of this Lease, or the application thereof to any person or circumstances, shall, to any extent, be held invalid or unenforceable for any reason, the remainder of this Lease, or the application of such provision or provisions to persons or circumstances other than those as to whom or which it is held invalid or unenforceable shall not be affected thereby, and every provision of this lease shall be valid and enforceable to the fullest extent permitted by law. If any provision of this Lease is deemed invalid or unenforceable by any court of competent jurisdiction, and if limiting such provision would make the provision valid, then such provision shall be deemed to be construed as so limited.

8.3 Governing Law. This Lease shall be governed in all respects by, and construed in accordance, with the laws of the State of Oregon.

9. Parties Bound;

9.1 Binding Effect. The covenants and conditions contained in the Lease shall apply to and bind the Parties and the heirs, legal representatives, successors and permitted assigns of the Parties.

9.2 Exception. The obligations of Landlord under this Lease shall not be binding upon Landlord named herein with respect to any period subsequent to the transfer of his interest in the Gardens as owner or lessee thereof, and in event of such transfer said obligations shall thereafter be binding upon each transferee of the interest of Landlord.

10. Miscellaneous;

10.1 Entire Agreement. This Lease contains all of the understandings relating to the leasing of the Premises and the Landlord's obligations in connection therewith and neither the Landlord nor any agent or representative of the Landlord has made or is making, and the Gardener in executing and delivering this Lease is not relying upon, any warranties, representations, promises or statements whatsoever, except to the extent expressly set forth in this Lease. All understandings and agreements, if any, heretofore had between the parties are merged in this Lease, which alone fully and completely expresses the agreement of the parties. This Lease may be modified in writing and must be signed by both Landlord and Gardener.

10.2 No Waiver. The failure of either party to insist in any instance upon the strict keeping, observance or performance of any provision of this Lease or to exercise any election in this Lease shall not be construed as a waiver or relinquishment for the future of such provision, but the same shall continue and remain in full force and effect. No waiver or modification by either party of any provision of this Lease shall be deemed to have been made unless expressed in writing and signed by the party to be charged. The receipt and retention by the Landlord of Monthly Maintenance fees, with knowledge of the breach of any provision of this Lease shall not be deemed a waiver of such breach.

10.3 Cumulative Rights. Landlord's and Gardener's rights under this Lease are cumulative, and shall not be construed as exclusive of each other unless otherwise required by law.

10.4 Indemnification. To the extent permitted by law, Gardener will indemnify and hold Landlord and Landlord's property, including the Gardens, free and harmless from any and all liability for loss, claims, injury to or death of any person, including Gardener, or for damage to property arising from Gardener's use and occupation of the Garden, or from the acts or omissions of any person or persons, including Gardener, in or about the Garden with Gardener's express or implied consent, except Landlord's act or negligence.

10.5 Legal Fees. In the event of any legal action by the parties arising out of this Lease, the losing party shall pay the prevailing party's reasonable attorneys fees and costs in addition, to all other awarded relief.

You will have the option of having your commissions sent directly to you or if you'd like to spend the money you receive from our affilate program in the General Store, we will add 50% more to that amount.

In other words, say, if you earn $500 a month from the affiliate program and choose to spend it in the General Store we would add an additional $250 to that!

You do not have to transfer all your commissions, any portion that you choose we would add 50% more to that amount.

Can General store credits be transferred into cash?

No, they can not.
